In the state of Florida, crimes are charged as either a felony or a misdemeanor, both of which have a broad range of possible consequences.

FELONY:
A felony is any criminal offense that is punishable under the laws of this state by death or term of imprisonment in a state penitentiary for each sentence which exceeds one (1) year. The types of felonies are:

  • Capital Felony: Life imprisonment(ineligible for parole) or death

      Possession of Cocaine with the Intent to sell/manufacture/deliver

  • Felony of the 3rd Degree: Term of imprisonment not exceeding five (5) years

      Aggravated Assault with a Deadly Weapon

MISDEMEANOR:
A misdemeanor is any criminal offense that is punishable under the laws of this state by a term of imprisonment in a county correctional facility for each sentence not in excess of one (1) year. Some examples of Misdemeanors are:

  • Driving Under the Influence
    Driving With a Suspended License
    Battery (Domestic or Simple)
    Possession of Marijuana
    Disorderly Conduct
    Obstruction of Justice
    Petit Theft
    Leaving the Scene of an Accident (without injury)
    Trespass
