Understanding Murder Charges
Murder is defined as the intentional, unlawful killing of another. In Florida, this is further categorized into two separate charges: first-degree murder and second-degree murder. First-degree murder involves causing the unlawful death of another, when premeditated (planned) and committed with malice aforethought. Causing the death of another person during the commission of a felony offense is also a form of first-degree murder, under Florida's felony murder rule. Second-degree murder is a lesser charge and involves an unlawful death caused by an act which shows an extreme disregard for human life. First-degree murder may be punishable by death or lifetime imprisonment without the possibility of parole. Second-degree murder may be punishable by up to 30 years in state prison.
