You might just be breaking the law, and not even know about it!! Hire an attorney and fight the case!!

Most Floridians don't know that it is illegal to have a license plate frame that covers the word Florida on their license plate. According to Florida statute, Section 316.605, you may be cited if the frame covers the word Florida. Why is this important for you to know? The police use this clearly unconstitutional statute (in my opinion) to stop many law abiding citizens when there is no bad driving pattern (speeding, reckless driving, etc). This, in turn, allows the police to make contact with the drivers and determine if they have alcohol on their breath, or whether they smell the odor of marijuana coming from the vehicle. It usually ends in an arrest. It is very important that you do not accept a plea offer in a case unless all options are exhausted. In a recent case where my client was arrested after police stopped him for violating the above statute and having marijuana in his vehicle, I fought the case and did not accept the prosecutor's initial offer to resolve the case. My client had already completed the diversion program in a prior case, and, as such, the prosecutor offered for my client to plea to the charge and have this arrest on his criminal record. I would not accept the offer. My client was a college student and it would almost guarantee that he would not be able to find a job after graduating college. I filed a Motion to Dismiss and a Motion to Suppress to point out the weaknesses in the prosecution's case and set the motions for a hearing. Ultimately, the prosecutor offered to dismiss the case. The moral of the story is: fight your case, exhaust all options to point out the weaknesses in the prosecution's case, and hire an experienced attorney like the attorneys at Hager & Schwartz, P.A..
